Public Liability Insurance

Public Liability Insurance provides protection to businesses and individuals against legal liability to third parties (the “public”) for bodily injury, death, or property damage arising from accidents connected with their premises, operations, or business activities.

It is one of the most common liability covers, especially for businesses interacting directly with customers, visitors, and the general public.


1. Insuring Clause – Promise to indemnify the insured against sums legally liable to pay for third-party bodily injury or property damage.

 

2. Limit of Indemnity – Maximum amount the insurer will pay per occurrence and/or in the aggregate.

Protects against unexpected financial loss due to third-party claims.

Covers both compensation and legal defense costs.

Enhances the business’s credibility (often a requirement in contracts or regulatory compliance).

Provides peace of mind for businesses interacting with the public.

This Policy indemnify the Insured against all sums, which the Insured becomes legally liable to pay as damages in respect of:

  1. bodily injury (including death or disease) to any person
  2. loss of or damage to property
  3.  legal costs and expenses incurred with the written consent of the Company.

 

as a result of an accident occurring within the Geographical limits and during the Policy Period as stated in the Schedule and in connection with the Insured's business or operations specified in the Schedule.

 

Limit of Indemnity

The liability of the Company for all damages legal costs and expenses payable for any one loss occurring during the Period of Insurance shall not exceed the sum stated in the Schedule as the Limit of Indemnity for any one loss.

 

The liability of the Company for all damages legal costs and expenses payable for all losses occurring during any one Period of Insurance shall not exceed the sum stated in the Schedule as the Limit of Indemnity for any one Policy Period.

The Company will not indemnify the Insured against liability arising from

 

1.        bodily injury (incl. death or disease) of any person under the contract of service or apprenticeship with the Insured if such bodily injury or illness is arising out of and in the course of his/her employment;

 

2.          bodily injury (including death or disease) loss of or damage to property caused by any product designed, sold, supplied, installed, erected, repaired, altered or treated by the Insured.

 

3.          Loss of or damage to property belonging to or in the care, custody or control of the Insured or any person employed by or working for the Insured;

4.                 Libel or Slander;

 

5.                 infringement of plans, copyright, patent, trade name, trade mark or registered design;

 

6.      any contract or agreement whether written verbal or implied which increases

         the Insured's Legal Liability unless such liability would have attached

         notwithstanding any such contract or agreement;

 

7.      fines, penalties, punitive exemplary or treble damages or any other damages resulting from the multiplication of compensatory damages;

 

8.1    bodily injury (incl. death or disease) loss of or damage to property arising out of the discharge, dispersal, seepage, migration, release or escape of pollutants (environmental impairment). Pollutants mean any solid, liquid, gaseous or thermal irritant or contaminant including waste. Waste includes materials to be

recycled reconditioned or reclaimed;

 

8.2    the cost of removing, nullifying or cleaning up seeping pollution or contaminated substances;

 

9.1    mining, processing, manufacturing, distributing, storage and/or removal of pure asbestos and/or products made entirely or mainly of asbestos;

 

9.2.        use of products made entirely or mainly of asbestos;

 

10.1  ionizing radiations or contaminations by radioactivity from any nuclear fuel or from any nuclear waste from the combustion of nuclear fuel;

 

10.2  radioactive toxic explosive or other hazardous properties of any explosive nuclear assembly or nuclear components thereof;

 

any consequence of war, invasion act of foreign enemy hostilities (whether war be declared or not) civil war, rebellion, revolution, insurrection, military or usurped power, terrorism or sabotage;

 

12.1  any vehicles (or trailer attached thereto) licensed for public road use or for which compulsory insurance or security is required by any road traffic legislation if such vehicle is owned, leased, hired, borrowed or driven by the Insured;

 

12.2  the loading or unloading by or of any vehicles, trailer, vessel or water craft;

 

13.    bodily injury (incl. death or disease) loss of or damage to property as a result from a deliberate or wilful act or omission of the Insured or any person employed by or working for the Insured provided that the result could reasonably have been expected by the Insured employee having regard to the nature and circumstances of such act or omission;

 

14.   bodily injury (incl. death or disease), loss of or damage to property as a result an accident which happened outside the Geographical Scope stated in the Schedule

 

15.    bodily injury (incl. death or disease), loss of or damage to property caused by or through or in connection with or arising from any lift, elevator, escalator or crane which is owned or used by or in the possession of the Insured or for the maintenance of which the Insured is responsible.
